Refund policy

Thank you for shopping with assayify. We sell IGI-certified lab-grown diamonds and jewelry, shipped internationally from China. Because these are high-value items, please read this policy carefully. By completing your purchase, you agree to the terms below.

1. Our General Position Under Canadian Law

Under Canadian law, retailers are not legally required to refund or exchange non-defective goods simply because a customer changes their mind. This is confirmed by the Government of Canada's Office of Consumer Affairs (Innovation, Science and Economic Development Canada) and by provincial law, including the Ontario Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A. Accordingly, assayify accepts returns only in the situations described in Section 2 below.

2. When You ARE Entitled to a Return or Refund

You may return an item and receive a full refund (including original and return shipping where applicable) if any of the following applies:

  • (a) The item is defective or not of acceptable quality. This right arises from the implied conditions of quality and fitness under the applicable Sale of Goods Act and provincial consumer protection legislation, and it cannot be excluded by any "final sale" term.
  • (b) The item does not match its description — for example, it differs from the product listing or from its IGI/grading certificate (carat, colour, clarity, cut, or measurements).
  • (c) Statutory cancellation rights apply under the Ontario Consumer Protection Act, 2002 for an internet agreement where the total price exceeds $50:
    • Section 40(1): if we did not disclose the information required by Section 38(1), or did not give you an express opportunity to accept, decline, or correct errors before entering into the agreement, you may cancel within 7 days after receiving a copy of your agreement.
    • Section 40(2): if we did not provide a copy of your agreement as required by Section 39, you may cancel within 30 days of the order date.
    • Non-delivery: if your order is not delivered, you may cancel and obtain a refund.

Where you validly cancel under these statutory provisions, we will provide a refund within 15 calendar days, as required by the Consumer Protection Act, 2002.

3. When Returns Are NOT Accepted

Outside the situations in Section 2, returns are not accepted. This includes, in particular:

  • Change of mind / buyer's remorse, where the item is free of defects, matches its description, and all required information was disclosed before purchase. Canadian law does not grant a general "cooling-off period" or unconditional right of return for online purchases of non-defective goods.
  • Items returned after the return window set out in Section 4.
  • Items returned without the original IGI/grading certificate, or not in their original, unworn, unused condition and packaging.

4. How to Request a Return

  • We strongly recommend you film an unboxing video before opening the inner packaging. This protects both you and us in the event of transit damage, a missing item, or any dispute.
  • Contact us at summercarx@gmail.com within 7 days of delivery to request a Return Authorization (RA).
  • Once authorized, the item must be shipped back within 3 days. Returns sent without prior authorization will not be accepted.
  • For approved returns, refunds are processed within 7 business days of our receiving and inspecting the returned item.

5. Defective or Mis-Described Items

If your item is defective or does not match its description, we cover return shipping and will replace it or issue a full refund. This right cannot be waived by any "final sale" or "no returns" term.

This policy does not affect your statutory rights under applicable Canadian federal and provincial consumer protection law.
